This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Platform and tells You about Your privacy rights and how the law protects You.

- Interpretation and Definitions
a. Interpretation
If any word is used that denotes gender it should be interpreted to include an individual of any gender. The words of which the initial letter is capitalized have the meaning ascribed to it under Section (b) below unless indicated otherwise. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural form. When words such as “You” or “Your” or similar pronouns are used they shall all mean any individual or legal entity accessing or using the Platform (defined below) on behalf of themselves or anyone else. When words such as “We”, “Our”, “Us” or similar pronouns are used, they shall in every instance refer to Kwekence, LLC, the entity operating this Platform. Headings in this document are for convenience purposes only and should not affect or be used to interpret any portion of the Agreement. In the event of any ambiguity, all words should be interpreted within the reasonable context, meaning and purpose of this Agreement.
b. Definitions
For the purposes of this Privacy Policy: Account means an online account that was created by You that is not shared with anyone else that is uniquely and exclusively Yours that You use to access Our
Platform or aspects of Our Platform.
Affiliate means an entity that controls, is controlled by or is under common control with a person, where "control" means the power to direct activities of a person (whether natural or corporate) that most significantly impact economic performance and potential to receive significant benefits or absorb significant losses.
Business, for the purpose of CCPA/CPRA, refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California. Company means Kwekence, LLC, 5000 Thayer Center Ste. C Oakland, Maryland 21550, and equally references to "We", "Us", or "Our" in this Agreement shall mean Kwekence, LLC, 5000 Thayer Center Ste. C Oakland, Maryland 21550 and its affiliates, agents, successors, assigns, subsidiaries, officers, directors, and employees.
CCPA and/or CPRA refers to the California Consumer Privacy Act (the "CCPA") as amended by the California Privacy Rights Act of 2020 (the "CPRA").
Consumer, for the purpose of the CCPA/CPRA, means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.
Content means content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You on the Platform, regardless of the nomenclature, type, and/or form of such content.
Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
Country refers to: United States
Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
Device means any device that may be used to access the Platform and Order the Service such as a computer, a cellphone or a digital tablet or any other device (regardless of nomenclature or type).
Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet Users to control the tracking of their online activities across websites.
Facebook Company Page is a public profile named Kwekence specifically created by the Company on the Facebook social network, accessible from https://facebook.com/kwekence
GDPR refers to EU General Data Protection Regulation.
Kwekence means the Platform (defined below).
Mentor means any person who uses the Platform to advertise and offer their services as a Service Provider of mentorship services.
Mentorship Services means any instructional, scaffolding, educational and or coaching services provided to a mentee for a fee in a specific field of study or subject area for their own personal or professional development. Mentorship services does not include the provision of legal counsel, medical advice, or any other professional assistance whose professional and ethical responsibilities might conflict with these Terms.
Personal Data is any information that relates to an identified or identifiable individual. For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity. For the purposes of the CCPA/CPRA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.
Platform means the Platform comprising Kwekence website and/or application hosting an online marketplace for Mentorship Services which may be found at www.kwekence.com.
Platform Data and Information Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Platform on behalf of the Company, to perform services related to the Platform or to assist the Company in analyzing how the Platform is used. For the purpose of the GDPR, Platform Data and Information Service Providers are considered Data Processors.
Third-Party Providers refers to Platform Data and Information Service Providers, Our Affiliates, Our business partners, Our Payment Processors, and or Third party providers to whom You or Your agents authorize Us to disclose Your personal information in connection with products or services We provide to You. Usage Data refers to data collected automatically, either generated by the use of the Platform or from the Platform infrastructure itself (for example, the duration of a page visit).
Users means any Mentorship Service Provider, Client, visitor, and any other person who accesses and uses the Platform in any way.
Website refers to Kwekence, accessible from www.kwekence.com
You means the individual accessing or using the Platform, or the company, or other legal entity on behalf of which such individual is accessing or using the Platform, as applicable. Under GDPR, You can be referred to as the Data Subject or as the User as you are the individual using the Platform.
- Collecting and Using Your Personal Data a. Types of Data Collected
i. Personal Data While using Our Service, We (or Our third party providers) may ask You to provide Us with certain personally identifiable information that can be used to contact or identify and verify your identity. This information is provided to Us by you voluntarily and for the exclusive purpose of using this service. Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Phone number
- Address, State, Province, ZIP/Postal code, City
- Listing information
- Government issued identification.
- Publicly available information
- Job Title
- Username
This information is stored and collected for the purpose of carrying the fundamental and vital business interest which includes, but is not limited to, verifying the identity and qualification (where relevant) of Users and to provide Users a reasonable means of identifying Users best suited for mentorship services.
ii. Platform interaction Usage Data. Our analytics tool keeps an account of such information as: Page url, User browser information, User operating system information, User device type, the country or region or city the User is interacting with the Platform from and the User http referrer. This information is collected without storing any personal identifying information about individual Users. This information is stored and collected for the purpose of carrying the fundamental and vital business interest which includes, but is not limited to, ensuring that Our Platform is fully functional to all Users and to assess, on a macro level, User interest in Our Platform.
iii. Data related to Platform Communication and Service Interactions. The Platform stores and collects any information derived from email communications or correspondence between it and the User. The Platform stores and collects all information originating from mentee and mentor reviews. The Platform stores and collects all information related to and originating from booking related information. This information is stored and collected for the purpose of carrying the fundamental and vital business interest which includes, but is not limited to, ensuring that Our Platform is fully functional to all Users and to make reasonable efforts to ensure that Platform transactions are occurring securely and efficiently.
b. Information from Third-Party Social Media Services The Company may provide you the ability to create an account and log in to use the Platform through the following Third-party Social Media Services: § Google § Facebook § LinkedIn If You decide to register through or otherwise grant Us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your email address, Your activities or Your contact list associated with that account. You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service's account. If You choose to provide such information and Personal Data, during registration or otherwise, You are giving the Company permission to use, share, and store it in a manner consistent with this Privacy Policy.
c. Tracking Technologies and Cookies Cookies are software tools that website owners use to provide an array of services to users. These tools collect data from users that help websites provide an array of services including inquiring information about users and facilitating website functionality. We may use Cookies and similar tracking technologies to track the activity on Our Platform and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze Our Service. The technologies We use may include:

§ HTML Local Storage. Certain sections of Our Platform may contain a technology supported by web browsers that affords websites the ability to store a users local data on their own device. This data can record the users general preferences when it comes to interacting with the website and it remains stored persistently. This mean that it will remain stored on your device until it is either removed by the user or website owner. All Cookies used by this site are required. The HTML local storage functions persistently meaning that it operates without an expiration date or period.
d. Use of Your Personal Data The Company may use Personal Data for the following purposes: § To provide and maintain Our Service, including to monitor the usage of Our Service.
§ To manage Your Account: to manage Your registration as a User of the Service. The Personal Data You provide can give You access to different functionalities of the Platform that are available to You as a registered User.
§ For the performance of a contract: the development, compliance and undertaking of the purchase contract for services You have purchased or of any other contract with Us through the Service.
§ To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
§ To provide You with news, special offers and general information about other goods, services and events which We offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
§ To manage Your requests: To attend and manage Your requests to Us.

Similarly, other Users will be able to view descriptions of Your activity, communicate with You and view Your profile.
§ With Your consent: We may disclose Your personal information for any other purpose with Your consent.
e. Retention of Your Personal Data The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with Our legal obligations (for example, if We are required to retain your data to comply with applicable laws), resolve disputes, and enforce Our legal agreements and policies. The Company will also retain Usage Data for internal analysis purposes. - Detailed Information on the Processing of Your Personal Data The Platform Data and Information Service Provider We use may have access to Your Personal Data. These third-party vendors collect, store, use, process and transfer information about Your activity on Our Platform in accordance with their Privacy Policies.

Analytics The third-party Platform Data and Information Service Provider We may use to monitor and analyze the use of Our Platform include but may not be limited to: § Plausible Analytics Plausible is a web analytics service that is designed to provide website owners with a privacy focused alternative to some of the other major data analytic services. Plausible collects only data that is essential for analytical purposes and unlike other alternatives, Plausible does not track Users as they navigate from across websites and does not use cookies for the purpose of tracking individual Users. Moreover, Plausible all data collected by Plausible lacks personal identifying information. The function Plausible performs however is similar – It informs website owners what pages are being viewed, how many times its being viewed, and overall activity of a website without collecting User data through cookies or tracking Users individually.
b. Email Marketing We may use Your Personal Data to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. You may opt-out of receiving any, or all, of these communications from Us by following the unsubscribe link or instructions provided in any email We send or by contacting Us. c. Payment Services We use Stripe, a third-party payment processing services to process the purchase of services on Our site. Stripe may collect from You sensitive financial information needed to process payments on the Platform .The payment information used by this third-party payment processing services is not collected or stored by Our Platform. The payment information You provide to this third-party payment processing services is provided to them by you directly and with Your consent. d. YouTube We may use YouTube, a third-party video streaming Platform, for marketing and informational purposes. Our Platform may use Third Party Services to acquire information related to your identity and criminal background. You acknowledge that the information these Services provide Us may not be accurate. You also acknowledge that in the event your reputation is harmed, damaged or you experience any other form of injury as a result of Us being in possession of such information, your sole remedy or opportunity for redress - outside of requesting Us to delete the information, is against the Third Party Website or Third-Party Providers.
